AUTO ACCIDENT FAQ’s

What is personal injury?

Personal injury is a legal term for an injury to the body, mind or emotions, as opposed to an injury to property.

I am not the at-fault driver, what are my legal rights?

Your rights include to be made whole, to have your insurance carrier handle your claim in a commercially responsible fashion, and to be compensated for your injuries.

My insurance carrier is not paying my claim, what are my options?

Depending on the coverage of your policy, your carrier is legally obligated to conduct a reasonable investigation and to pay just claims. If they fail to provide you their just reasons for denying your claim, call for a free consultation to explore your options.

What is PIP?

Personal Injury Protection (PIP)

Car insurance is available in Massachusetts that covers medical expenses and, in some cases, lost wages and other damages. PIP is sometimes referred to as “no-fault” coverage, because the statutes enacting it are generally known as no-fault laws, and PIP is designed to be paid without regard to “fault,” or more properly, legal liability. PIP is also called “no-fault” because, by definition, a claimant’s, or insured’s, insurance premium should not increase due to a PIP claim.

What is Med-Pay?

Insurance coverage that follows the vehicle. If you are in a vehicle that has med pay coverage on its policy, you will likely be a covered insured under the med pay coverage of the policy. However, you may be a covered insured for med pay coverage under more than one policy. It is best to consult attorney to be sure you know which policies may cover you under the medical payments coverage of the insurance policy.

What is a contingent fee?

A contingent fee is the legal expense associated with the successful recovery of damages. When you are injured in an auto accident, the attorney is paid only if they are able to recover damages, usually 1/3 of the total claim paid.
